City Council secures High Court injunction against unauthorised Denmead development
Winchester City Council (WCC) has secured a High Court injunction to stop ongoing unauthorised development in Denmead.
The injunction, granted by the High Court (King’s Bench Division) on 5 June 2026, follows evidence presented by the council demonstrating continued breaches of planning control at the site to the north of Forest Road.
The order places strict legal restrictions on activities at the site, including prohibiting the stationing of any further caravans, mobile homes, or other residential accommodation without planning permission; use of the land for residential purposes; connecting existing structures to utilities such as septic tanks or infrastructure; any building, engineering or other development works; and the further importation of materials not linked to lawful agricultural use.
The order will remain in force until 4 June 2028, unless it is varied or discharged by the court. The defendants have been ordered to pay £6,000 in legal costs to the council.
A temporary injunction regarding the site had been initially granted to WCC by the High Court on 29 May.
Cllr Jackie Porter, Cabinet Member for Place and the Local Plan at Winchester City Council said: “We are delighted that this injunction has been granted, and it demonstrates that at Winchester City Council we will take firm and decisive action where there are serious and ongoing breaches of planning control.
“We are absolutely committed to protecting our district from unauthorised development and ensuring that development takes place in accordance with the law. Where necessary, we will pursue enforcement through the courts to achieve this.”
