Witness evidence key to fly-tip prosecution by Winchester City Council

A Hampshire man has been convicted of a fly-tipping offence in the Winchester district.

Mark Walter Way, a 39-year-old resident of Elkstone Road, Portsmouth, pleaded guilty at Basingstoke Magistrates Court on Tuesday 26 March 2024.

Key evidence was supplied by a motorist who witnessed the offence taking place in Crooked Walk Lane, Southwick in February last year. Mr Way admitted to controlling the use of the offending vehicle at the time of the offence.

After being prosecuted by Winchester City Council, Mr Way was sentenced to a fine of £200, prosecution costs of £825.85, a compensation order for clearance costs to Southwick Estate of £125 and a victim surcharge of £80, making a total of £1,230.85.

Recent fly-tipping prosecutions have also been achieved by Winchester City Council in November 2023, January 2024 and February 2024.

Winchester City Council Deputy Leader and Cabinet Member for Finance and Performance Cllr Neil Cutler said: “Fly-tipping has a hugely negative impact on our communities, as well as causing untold harm to the local environment and wildlife. Witnesses are crucial to providing the necessary evidence, as it has proved in this case, and we encourage anyone who witnesses a fly-tipping incident to come forward.

“We would ask anyone with any reports or evidence to submit it to us via the Your Winchester app, the report form on the council website - Fly-Tipping - Winchester City Council - or by contacting our Customer Services Team on 0300 300 0013. We’re determined to continue to take action against those who commit this crime.”
