Laws for Alcohol Sales at Community Premises

On 29 July 2009, new laws came into force which
makes it easier for alcohol to be sold at community premises. Until now, all
premises where alcohol was to be sold required a premises licence issued
under the Licensing Act 2003, or a Temporary Event Notice (TEN). If alcohol
was sold under a premises licence, there had to be a Designated Premises
Supervisor (DPS) who had to hold a personal licence issued under the Act.
This was no
real problem for premises such as pubs, clubs and restaurants, but it did
pose problems for village halls and other community premises which were hired
out for weddings and the like, or when a bar was required at a performance of
a play or other event. If alcohol was to be sold TENs
had to be submitted. These were
limited to 12 per calendar year, up to 96 hours each, with a cumulative
total of 15 days. In some cases village halls enlisted the
help of a local pub landlord to be their DPS.
Under the
new rules, where a community premises already holds a premises licence to
sell alcohol, the management committee can apply to have the mandatory
condition for a DPS removed from the licence. This would be replaced with a
condition that the management committee would be responsible for the sale of
alcohol. There is a fee of £23 for this process.
Where a
community premises holds a premises licence for regulated entertainment
and/or late night refreshment but without the authority to sell alcohol, they
may apply to vary the licence to include the activity. This process involves
an application to the local authority which is copied to six other
responsible authorities (police, fire, etc.). The application also has to be
advertised by a notice placed at the premises and a public notice in a
newspaper. The application fee is calculated from one of five bands depending
on the non-domestic rateable value of the premises. When making an
application to include the sale of alcohol as a licensable activity, the
management committee can also apply to have the mandatory condition relating
to the DPS disapplied. The additional fee of £23 is
waived for this type of application.
When making
an application to disapply the mandatory condition,
the management committee will need to demonstrate how the supervision of the
sale of alcohol will be managed. The application should also be accompanied
by a sample hire agreement which should point out the responsibilities of the
hirer if alcohol is to be sold. The agreement for such sales to take place
would be a decision solely for the management committee. Sample agreements

Village Plan brings Fun for Families in South Wonston
Arts and crafts
activities for parents and children have been established recently in South Wonston as a result of the Village Plan.
Southampton Scrapstore has run a number of sessions
at the Village Hall with parents and children from South Wonston, with a good turn out of families eager to
use the Scrapstore's materials and to enjoy quality
time with their children. The popularity of these events in this rural
community, has led the Scrapstore to organise
further workshops in South Wonston during the summer
holidays.
The activities came about after South Wonston
Village Plan identified a need for more events and activities in the
village. The Council's Community Planning Team brought this to the
attention of Southampton Scrapstore, who had some
funding to run activities in this part of rural Hampshire. With the
evidence of need demonstrated by the Village Plan, the Scrapstore
were happy to help.

Community Plans for Alresford and Whiteley
The
parishes of New Alresford and Whiteley
have both published a revised and updated community plan in recent months.
The Alresford Healthcheck builds on, and supersedes, the Town Plan
produced in 2004. Successful completion of the Healthcheck
secured more than £110,000 from SEEDA to improve parking and footpaths in the
town, creating a more welcoming town for pedestrians and to ensure the
ongoing success of Alresford businesses. This
project is now well underway and was one of the major aspirations of the
original Town Plan. Implementation of the many actions identified in the
Healthcheck will be overseen in the coming years by
the Alresford Town Partnership.
The Whiteley
Parish Plan 2009 follows on from the first Whiteley
Parish Plan, published in 2004. The process included a large scale
survey of all residents in Whiteley and identified
issues of importance to residents now and also their priorities for the
future, as Whiteley develops. Key issues that
emerged were tackling traffic/transport problems and improving community
facilities and services.
In addition
to bringing about changes and improvements at a local level, both plans have
been incorporated into the evidence base that has informed development of
Winchester City Council's Core Strategy Preferred Option.
Both plans
can be viewed via the community planning pages of Winchester City Council
website. Also available are the results of community surveys and other
evidence that helped to inform them as well as the original community plans
that preceded them.

LDF Core
Strategy Preferred Option Update
Thank you to all
those Parishes and individuals who made comments on our draft Core Strategy.
The consultation closed on 3 July with over 850 responses received, raising
around 4000 comments. All the comments received have now been placed on our
website and can be viewed at http://documents.winchester.gov.uk/preferredoption/Default.aspx
You can search this by name of respondent or policy number of the core
strategy, and view other comments made.
A series of
exhibitions was also held across the District during June approximately 600
people visited these and nearly 500 people viewed the exhibition on our web
site.
The next
steps in the process will be to assess all the comments received and report
these to the Council's LDF Cabinet Committee later this year.
Car Park
Office Relocation
The Winchester City Council
Parking office is moving from its current location in Middle Brook
Street to the Customer Service Centre in the Colebrook Street council offices.
The move is scheduled to take place over the weekend of 2 - 5 October and
will enable customers to contact the Council at one location.
Training
for Parish Councils
The 'Ethical Framework for Parishes' training is being offered to both
new and experienced Councillors and Clerks. The evening will cover the
provisions of the Code of Conduct, Register of Interest issues and
include a discussion about the application of the rules to everyday
situations.
