Gaming Machines Licence
A gaming machine licence is required in respect of premises providing amusements with prizes by way of machines.
The most common applications of gaming machines are those commonly referred to as 'fruit machines' and 'one-armed bandits' which make small payments. Typically these machines would be found in amusement arcades, as well as pubs and clubs. The Gambling Act 2005 changed the way that such machines are licensed. Only premises selling alcohol, or entertainment centres, will be permitted to have machines. Permits under the Gaming Act 1968 for machines which are provided in fast food takeaways will not be renewed when they expire.
Who needs a Gaming Machine Permit?
If a licensee wishes to make more than two gaming machines available he will need to obtain a Licensed Premises Gaming Machine Permit from the licensing authority by forwarding the completed form below with the relevant fee. There are a number of statutory conditions relating to the way in which gaming machines are used, and licensees will also need to ensure the compliance with the Gambling Commission's code of practice on the location and operation of gaming machines. A Gaming Machine Permit is valid for 10 years. You will be required to pay an annual fee in respect of your permit. Where a permit comes into effect on the date it is issued then the first annual fee for the permit has to be paid within 30 days after that date and then annually on the date of issue. If the annual fee is not paid on time, the licence will lapse.
Notification of 2 or Less Gaming Machines
Alcohol-licensed premises are entitled to a maximum of two gaming machines (each of which may be category C or D) without the need for a permit. The person who holds the relevant alcohol licence should notify the licensing authority of their intention to make gaming machines available, and pay the required notification fee.
A licence is not required where the machine in question is based only on a game of skill (for e.g. quiz machines), or is an amusement only machine and in either case no money or token is paid out by the machine.
