Data Protection Act
The Data Protection Act 1998 gives you the right to access personal data (information) about you.
If you would like to request personal information that Winchester City Council holds that relates to you, you should send a written request to the Head of Legal Services at the address below. You may chose to use the subject access form which you can download below together with Data Protection Guidelines.
Your request should include:-
- Your full name and address with date of birth
- Your full address and telephone number (with e-mail address if you have one)
- Any reference number relevant to the request
- Details of the information you want from the Council, for example " copies of my Housing Benefit file from 2006 to 2007-05-09
The fee of £10, set out in the Data Protection Act, should be included with your request. Failure to include the fee will result in a delay in dealing with your request. The £10 fee covers only one file or system so, if for example you wish to have personal information held by the Housing Benefits section and by the Council Tax section, the fee would be £20. The Data Protection Act requires us to provide a full response to your request within 40 days however most requests will be handled more quickly.
Some Departments may be able to provide copies of small amounts of personal information or access to your file without requiring a formal request. For example, if you are a tenant of the Council, you will usually be able to look through your tenancy file provided you give 7 days notice.
